When communications companies are faced with a potential FCC enforcement action, they often turn to David, a nationally recognized expert in FCC enforcement matters.  He provides strategic advice to clients navigating FCC investigations and complaint proceedings, advocates and litigates for them, and negotiates settlements where advantageous.

His enforcement perspective and experience is long-standing and unique.  While in the FCC’s Office of General Counsel, including as Deputy General Counsel, David led the development of the FCC’s Forfeiture Policy Statement and oversaw the internal review of ALJ decisions.  He organized the newly created Enforcement Bureau and served as its first and longest-tenured chief, under chairmen of both parties.  And he has represented clients in more than 100 FCC investigations and complaint proceedings.

  • Successfully litigated for a long-distance carrier two formal complaints against “traffic pumpers” and successfully argued in the DC Circuit as intervenor supporting the FCC’s decisions
  • Successfully defended a cable operator in a program carriage complaint case before an administrative law judge, and assisted in defense of the ALJ’s decision before the FCC and the Ninth Circuit
