Wilkinson Barker has an extensive practice concerning enforcement of the Communications Act and FCC rules and orders, headed by the FCC’s former Enforcement Bureau Chief.
The firm regularly represents clients in FCC investigations, audits, and monetary forfeiture proceedings. Its enforcement successes include convincing the FCC not to pursue enforcement action, convincing the FCC to cancel or reduce enforcement action, and negotiating numerous consent decrees. Firm attorneys also have extensive experience in formal complaint proceedings and hearings before administrative law judges. The firm has represented clients in FCC enforcement matters involving a wide variety of issues, including, for example, universal service, network outage reporting, inter-carrier compensation, number portability, E911, environmental and historic preservation regarding towers, communications equipment, telemarketing, privacy protection, disabilities access, indecency, digital television, EEO, children’s television, and sponsorship identification.
The firm works closely with clients in all areas of the communications field to provide them with effective and timely guidance concerning compliance requirements. This includes updates to clients regarding FCC enforcement activities and priorities, analysis of legal requirements, review of business operations, preparation of training materials, and the development of compliance plans and internal client procedures to ensure compliance. |
